| The first question many companies will need to answer when considering the likely impact of REACH on their business is whether their particular substances, either those bought in, those they manufacture or those they sell, are covered by the new REACH legislation. And this is not always as simple a question as one might imagine. As an example, it is acknowledged that REACH will cover all substances manufactured or imported into the European Union in the amount of one tonne or more per annum - however several product types are excluded from REACH, as they are already covered by existing health and environmental legislation – but which product types are these? |

| REACH will include many of the chemicals used in the manufacture of exempted products, and even some of the exempted ingredients……………. Similarly, REACH exempts a whole range of natural based materials, such as ores, plant extracts and gases, but these exemptions are by no means predictable………and what may be even more confusing to any new to REACH is that the text of the legislation does not bring this information together in one place. Just to confuse, it is scattered through several articles and annexes to the regulation. |
