CLP Regulation Basics

What is the CLP Regulation?

CLP is a new system of classification and labelling based on international agreements known as the Globally Harmonised Scheme (GHS). It is being phased in so that the burden on business is reduced. CLP will progressively replaces the Dangerous Substances and Dangerous Preparations Directives, so labels will change slowly over the next few years. As in the past, the CLP Regulation requires chemicals to be classified for their hazards and labelled accordingly. Under CLP labels will be very different to the old scheme in the EU. CLP also has some important additional requirements which will require action – possibly before you have to alter your labels.

What is the scope of CLP?

CLP has broadly the same scope as the old scheme. It deals with the bulk of chemicals which are put on the industrial and domestic market for a third party (including those supplied free of charge). A few chemicals are exempt – for example cosmetics and medicines.

When does CLP start?

It has already! CLP entered into force in January 2009 and many parts of the CLP Regulation applied from 1 December 2010.

For example, the classification and labelling parts of CLP now applies to all substances placed on the market although those in the supply chain (e.g. on the shelves) are OK until December 2012.

CLP will apply to mixtures from June 2015, again with a further two years to deal with products in the supply chain.

Other parts of CLP such as notification to the inventory apply across the board now and have done since 1 December 2010...

What are the main provisions?

The big story in the CLP Regulation is the new system for classification and labelling. These are major changes to what existed in the past. You will need to set aside time, energy and money to deal with these changes. The vital first step is to make a business plan to deal with CLP, identifying people, funds and facilities.
